Amidst the popular demand for a CBI [Central Bureau of Investigation] probe into the death of actor Sushant Singh Rajput, the Bharatiya Janata Patry-led Central government informed the Supreme Court that it has accepted the plea of the Bihar government for a CBI probe into the actor’s death. The Union of India was represented by Solicitor General Tushar Mehta.

The Centre informed the SC during the hearing of the petition filed by actress Rhea Chakraborty in seeking transfer of her case in Bihar to Mumbai. Rajput’s father K.K Singh had filed a FIR against Chakraborty and her family in Patna on 25 July, accusing them of serious charges and abetting his son’s suicide.

A single bench judge of Justice Hrishikesh Roy is presiding over Chakraborty’s petition.

“Rajput was a talented artist who passed away under unusual circumstances. Now whether there is criminality involved needs to be investigate… Now everyone has an opinion about high profile cases but we will proceed as per law.” Roy said in the hearing, as reported by

Appearing for the State of Maharashtra, Sr. Advocate R Basant told SC, “There is no cause of action for Patna Police to register the FIR. Nothing has happened in Patna. This is a political case. [As per] Concept of federalism, two police cannot interfere in each other’s job. I can place all records to substantiate that we are doing a very professional job.”

Backing the case for Bihar police to investigate, Vikas Singh, the Rajput family lawyer said, “”Under Section 174 of CrPC, it is clear that only Patna Police can investigate and not Mumbai Police. No cognizable case registered in Mumbai.” The State of Bihar is being represented by Advocate Mukul Rohatgi.

The SC didn’t take it too kindly to Brihanmumbai Municipal Corporation’s decision to send Bihar IPS officer Vinay Tiwari, SP, Patna (Central) City, to quarantine.

“The quarantining of the Bihar police does not send a good message…Especially when the case has garnered so much media attention? State of Maharashtra has to ensure that everything is done in professional way,” said Justice Roy.

After listening to all parties, the SC bench noted, “”Serious allegations have been leveled against the petitioner (Rhea Chakraborty). She has applied for transfer of proceedings from Patna to Mumbai…Bihar Police has already entrusted investigation to CBI. SG Mehta has stated that in principle, Centre has accepted the CBI probe request.”

The SC has given three days to all parties to file their replies. The decision on Rhea Chakraborty’s petition has been pushed to next week. A final call on whether to shift the case to CBI is likely to be made soon.
